OFFICIAL RULES AND REGULATIONS
1. NO PURCHASE NECESSARY TO ENTER OR TO BE CHOSEN AS THE NEW MOM. The “Are You the Next Five Mom?” search is open to all legal residents of the United States. Employees (and their immediate families and household members, whether or not related) of the Consumer Healthcare Products Association (CHPA), and their respective member companies, subsidiaries, affiliates, franchisees and advertising or promotion agencies (collectively, the “Sponsors”) are not eligible to enter or win the Search. Void wherever taxed, prohibited or restricted by law. Search is subject to all applicable federal, state and local laws and regulations and shall be governed by law.
2. HOW TO ENTER: Starting May 2011, the Sponsors will conduct a national search to find the next Five Mom. This parent will have experience working with teens and/or substance abuse, and will become the campaign’s newest Mom. To enter, participants must submit a nomination statement of up to 500 words on why the nominee is most deserving of being selected as the next Five Mom. An entrant can nominate herself, or a friend. All submissions must be e-mailed to fivemomscampaign@gmail.com. No other materials will be accepted by Sponsors in connection with the Search. All entries must be submitted in the name of an individual person. Limit one (1) nomination per person.
Sponsors are not responsible for misdirected, inaccurate, incomplete, lost, late, delayed, undelivered, damaged or illegible entries, and all such entries will be void. Sponsors are also not responsible for technical, hardware, or software failures of any kind, or other errors or problems which may occur in connection with or relating to the Search, whether computer, network, technical, mechanical, typographical, printing, human or otherwise, including, without limitation, errors or problems which may occur in connection with the administration of the Search, and the processing or judging of entries. Sponsors reserve the right, in their sole discretion, to cancel, modify or prematurely conclude the Search should any computer virus, malfunction, fraud, tampering, unauthorized intervention or other cause beyond their control corrupt the administration, security or proper operation of the Search. If the Search is cancelled, Sponsors may, in their sole discretion, judge all eligible entries received up to time of such action using the judging procedures outlined below to determine the next Five Moms. False or deceptive entries or acts will render the entrant ineligible and Sponsors reserve the right to disqualify any entrant (and void his/her entry) who attempts to undermine the legitimate operation of the Search by tampering with any Website mechanism, acts in a disruptive manner or violates these Official Rules. Any attempt by an individual to deliberately damage or undermine the legitimate operation of the Search may be in violation of criminal and civil laws. Should such an attempt be made, Sponsors reserve the right to seek remedies and damages (including attorneys’ fees) from any such person(s) to the fullest extent of the law, including criminal prosecution.
3. JUDGING: One Mom will be selected by a panel CHPA employees from all eligible entries received, based equally upon the following criteria: Has experience or passion for working with teens; Past or previous involvement in teen programming, or issues affecting teens; Experience working with teens and/or substance abuse; Has raised awareness of cough medicine abuse in their community or is a community leader; Works with teens on a daily or weekly basis a coach, teacher, guidance counselor, youth group leader, etc.; Uses social media to reach parents and educate them about teen substance abuse; Is involved with community organizations that center around pre-teens and teens; Developed an original idea or event to educate others about cough medicine abuse; or has distributed Five Moms and/or cough medicine abuse information to their children, peers, community, etc.
The decisions of the judges will be final and binding on all participants. The odds of being selected as a winner will depend on the total number of eligible entries received during the Promotional Period. The decisions of the Sponsors and judges will be final and binding on all matters.
4. SELECTION NOTIFICATION: The new Mom will be notified by Sponsors, and may be required to provide proof of identity, address and birth date, as well as execute and return an affidavit of eligibility, tax acknowledgment form, liability release and, except where prohibited by law, publicity release within three (3) days of date of issuance either via facsimile or US registered mail. If any potential Winner fails to do so or if: (i) any prize notification is returned as undeliverable, or (ii) a potential Winner is determined to be ineligible for reason, such potential Winner will be disqualified and, at Sponsors’ sole discretion, a runner-up will be notified.
5. PARTICIPATION IN CAMPAIGN: The new Mom will participate in the Five Moms campaign as one of our Moms and as such, agrees to participate in campaign activities, including but not limited to: Participation in media opportunities/interview when available/as requested; Reviewing blog posts, articles, and blogger outreach for FiveMoms.com; Participation in e-mail communications; or participation in web chats/casts or phone interviews with bloggers on an as-needed basis upon request. All communications, publications and postings related to the campaign must be reviewed and approved by us before their release.
6. COMPENSATION: The new Mom will not be compensated for her time or involvement in the Five Moms campaign. However, we will reimburse any routine expenses needed to fulfill responsibilities in connection with the Five Moms campaign, such as postage or travel expenses for any travel taken at our request.
7. GENERAL RULES AND REGULATIONS: By entering this Search, entrants: (i) agree to be bound by the decisions of Sponsors and judges which are final and binding in all matters; and (ii) grant Sponsors and their designees the right, unless prohibited by law, to use their names, cities and states of residence, voices, pictures and likenesses, without compensation, notification or permission, for the purpose of advertising and publicity in any and all media, now or after known, throughout the world in perpetuity. In addition, entrants forever waive and relinquish all so-called “moral rights (“droit moral”) now or hereafter recognized. Sponsors, expressly disclaim any responsibility and entrants agree to release, indemnify and hold Sponsors harmless for liability, damages or claims for injury or loss to any person or property (including death) relating to, in whole or in part, directly or indirectly, participation in this Search, the acceptance and/or subsequent use or misuse of any of the prizes awarded, claims based on publicity rights, defamation or invasion of privacy. Sponsors are not responsible for any injury or damage to persons or property which may be caused directly or indirectly, in whole or in part, from the downloading of any material from the Website, regardless of whether the material was prepared by Sponsors or a third party, and regardless of whether the material is connected to the Website by a hypertext link. Sponsors further assume no liability either for the cancellation, modification or premature conclusion of the Search for any reason or through the acts or defaults of any company or person providing any prize. All such losses or expenses must be borne by the affected participants and entrants.
